Number portability rules
1. The number portability shall only be made at the subscriber's request, when it decides to give up a supplier for telephone services destined to the public (donor supplier) and wants to sign a contract with another (acceptor supplier).
2. The performance of the porting process is entirely the liability of the acceptor supplier initiating such process upon the receipt of a porting application from the final user.
3. The term for finalizing the porting process cannot exceed, under normal conditions, 10 business days.
4. According to the provisions in force regarding number portability implementation, the existence of subscriber's debts to the donor supplier, the existence of a minimum duration of the contract or the suspension of the service supply through such number cannot represent reasons for refusing the application for number porting.
5. The contract concluded between the donor supplier and the subscriber regarding the service supply through the ported number shall cease upon the completion of the porting process, but the termination of the contract shall not prejudice the obligations of the subscriber and of the donor supplier resulted from the provisions of the contract concluded between them, born and not performed before its termination.
6. Therefore, the transfer to another supplier shall not exempt the subscriber from the observance of the provisions of the contract concluded with the donor supplier. For instance, the donor supplier may request the payment of penalties related to the early termination of the contract or of the potential debts, if such obligations are provided in the contract.
